By accessing or using any part of the Chur platform—including churapp.com, book.churapp.com, mobile versions, APIs, or associated tools—you agree to these Terms & Conditions in full, which govern your use of Chur’s services.
Chur is a scheduling and appointment management platform designed to support small businesses and independent professionals in managing their bookings, calendars, customer communications, and services. You must be at least 18 years of age and have the legal capacity to enter into these terms, and by creating an account, you affirm that all information provided is accurate, complete, and current.
You are solely responsible for maintaining the security of your account credentials and for all activities occurring under your account, including data uploaded, services created, and communications initiated through the platform.
You agree not to use Chur in any unlawful or unauthorized manner, and not to misuse the system by uploading malicious code, scraping or mining data, attempting unauthorized access to our infrastructure, misrepresenting your identity, interfering with platform performance, or infringing on the rights or privacy of other users. Chur retains the right to suspend or permanently disable any account at its sole discretion if it believes the terms have been violated or if the platform, its users, or its partners are put at risk.
You acknowledge that Chur may collect and process information, including personal data, in accordance with our Privacy Policy and that certain features (e.g., booking notifications, integrations with Google Calendar or Meta Pixel, usage analytics, and email reminders) rely on third-party services, which may have their own terms and privacy practices.
The use of raw or derived user data received from Workspace APIs will adhere to the Google User Data Policy, including the Limited Use requirements. This complies with Google's Limited Use restrictions.
You grant Chur a limited license to use, store, transmit, and display any data you input solely for the purpose of providing the service, and you confirm you have the necessary rights to share that data. All intellectual property rights to the platform, including source code, content, logos, trademarks, user interface, database structure, and functionality, remain the exclusive property of Chur or its licensors.
You may not copy, modify, reverse engineer, or reuse any part of the platform without written permission. If you subscribe to paid services, you agree to the pricing terms presented at the time of signup, which may include monthly, annual, or usage-based fees. All fees are billed in advance, are non-refundable except as required by law, and you authorize Chur to charge the provided payment method on a recurring basis unless the subscription is cancelled according to the instructions provided in your account.
Chur reserves the right to change pricing, features, or billing frequency with reasonable notice. We make no guarantee that the service will be uninterrupted, error-free, or meet your business requirements, and you acknowledge that temporary service disruptions may occur due to maintenance, updates, internet outages, or issues outside our control. To the fullest extent permitted by law, Chur disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and shall not be liable for any indirect, incidental, or consequential damages—including lost profits, loss of data, business interruption, or reputational harm—arising from the use or inability to use the platform, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Chur and its affiliates, directors, employees, and partners from any claims, liabilities, losses, and expenses arising from your use of the service, your breach of these terms, or any content you provide. These Terms & Conditions are governed by the laws of New Zealand, and any disputes shall be resolved in the courts of that jurisdiction.
If any part of these terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. These terms constitute the entire agreement between you and Chur regarding the use of the platform and supersede any prior agreements.
We may update these Terms & Conditions at any time to reflect changes in our business, the platform, or legal requirements. We will notify users of material changes via email or platform banners, and continued use of Chur after such updates indicates your acceptance.
